E-commerce - The Paris TGI has jurisdiction over an Italian website targeting a French audience

In a judgment dated 14 January 2016, the Tribunal de grande instance de Paris (Paris Regional Court) ruled that it had jurisdiction in a dispute concerning the infringement of a French trademark by an Italian company on its Italian website.

The TGI considered that the Italian site was aimed at a French audience and therefore had a significant and sufficient link with France because of :

  • translation of its content into French
  • the presence of the contact details of a distributor in France of the Italian company's products.
