CNIL fines Le Figaro 50,000 euros for non-compliance with cookie rules

During several inspections of the lefigaro.fr website over a period of 2 years, the CNIL noted breaches of the rules in force on cookie management.

As a result, and despite the introduction of a number of tools (consent management platform, tools for identifying the cookies placed, etc.), third-party advertising cookies were placed before the user's consent was obtained or despite the user's refusal.

The origin of the cookies installed has no bearing on the responsibility of the site publisher, insofar as it has control over its site and its servers. The CNIL therefore considered, in accordance with the case law in force, that Le Figaro, as publisher of the website, was responsible for the cookies deposited by third-party partners on its site. As such, Le Figaro had a duty of care to ensure that its partners complied with the legislation in force, particularly with regard to user consent.
