Press law - Outsourcing the role of website moderator does not exempt the publication director from criminal liability

In a ruling handed down on 3 November last, the Cour de cassation ruled that the publication director of a personal contribution space could not rely on the following grounds

  • or outsourcing the moderator function to a service provider,
  • provisions relating to the criminal liability of website hosts

to release it from its own criminal liability in the event of publication of defamatory statements in the aforementioned area.
